Failure to pay as agreed will result in dismissal from TLAP Sports Academy Preparatory. Terms of this agreement are laws governed by the state of Florida. The academy has many fixed expenses, among them faculty salaries and campus maintenance.

In order to plan and maintain these services over the entire year, it is essential that the revenues from the fees be assured. For this reason, it is understood that the students are enrolled for the entire school year (or such portion as may remain after the date of enrollment.

TLAP Sports Academy withdrawal, or dismissal policy terms:
Therefore, it is the academy’s policy that no reduction or refund of fees is allowed for absence, withdrawal, or dismissal. No refund is allowed for any absence or early withdrawal or dismissal due to:

1. The use or possession by the student of alcohol or any drug, narcotic or an agent which is similarly classed or has similar effects unless given by and while under the care of a legally qualified medical practitioner.

2. Actions by the student that might endanger other students, faculty, staff, or school property.

3. Intentionally self-inflicted injuries.

4. Boycotting of classes or play by the student.

5. Closure of the school or inability to operate caused partially or wholly, directly or indirectly, by fire, flood, earthquake, elements of nature or acts of God, acts of war or terrorism, labor strikes, civil disorders, acts of governmental or judicial authorities, government- imposed shutdown and/or delay, pandemic, epidemic, public health care crises, quarantine or other disease control measures.

6. Destruction of any school facility due to any cause whatsoever.

7. Inability of the academy to operate and provide formal academic instruction, including closure for any reason.

8. Student being inducted or drafted into the Armed Forces including alternative duty as a conscientious objector.

9. Fighting.

10. Not following academy rules & being disrespectful to staff.

11. Early withdrawal or medical withdrawal. In addition, no refund is available for a withdrawal or absence from class attendance for the balance of the academic year due to early completion of academic requirements or early graduation, student’s temporary absence or suspension, or a change from resident to day status.

This tuition offer includes confidential and/or proprietary information, intended solely for the recipient and his family (authorized) representatives, and may be used only by the individual(s) or entity to which it is ad-dressed. The information in this document is the sender's business confidential, subject to copyright or constitutes a trade secret, and may be legally privileged.

Access to this document by anyone else is unauthorized. If the reader of this terms of enrollment is not the intended recipient, or his or her authorized representative, the reader is hereby notified that any disclosure, dissemination, distribution, publishing, copying of this communication, or any action taken or omitted to be taken in reliance on this terms of enrollment is strictly prohibited and may be unlawful without the prior written consent of (TLAP).

This document constitutes a binding AGREEMENT under the laws of State of Florida between (PLAYER) who, as well as jointly and severally by the undersigned parent or legal guardians of the PLAYER (PARENT) and the TLAP Sports Academy Preparatory. This AGREEMENT is established for the purpose of de-fining the mutual obligations between (TLAP) and the PLAYER as well as (TLAP) and the PARENT for the 2023 2024 season.

The intent of this AGREEMENT shall not be negotiated due to typos, errors, or misprints. The academic (Year) shall be defined by the parameters of the school year and game schedule.

1. During the school the PLAYER agrees to play basketball exclusively for (TLAP) and shall not participate or play in any other events, with the unique exception of select camps, or tournaments, without the express written permission of (TLAP) which shall be reasonably granted whenever such outside participation is determined by (TLAP) to not be in conflict with the interests of (TLAP).

2. The player agrees that he shall attend all (TLAP) all but not limited to: practice, games, training, instructional sessions, team meetings and organized educational prep sessions, unless otherwise excused by (TLAP) prior to noted activity.

3. The player agrees that he will conduct himself on and off the court in accordance with the highest standard of honesty, citizenship, and sportsmanship. The PLAYER further agrees that he will not do anything that is materially detrimental or materially prejudicial to the best interests of (TLAP) in recognition that his behavior is representative of (TLAP) at all times. The PLAYER further understands that (TLAP) may dismiss PLAYER at will for failure to uphold good citizenship and behavior and violation thereof shall, at the sole discretion of (TLAP), be the basis for suspension or termination of player's service.

4. The (TLAP) and PLAYER formally recognize that this AGREEMENT does NOT constitute a guarantee of playing time, or of equal playing time, for the PLAYER and that all decisions regarding playing time shall be determined solely by (TLAP) as it sees fit. PLAYER understands he will continually compete for a playing position; and that (TLAP) makes no representation regarding the total number of players that (TLAP) will carry at the PLAYER'S position. Skill and effectiveness in both practice and games are determining factors to playing time, to be determined in (TLAP) sole discretion. PLAYER and PARENT understand that part of the player development process may include placement on any appropriate team operated by (TLAP). All teams are operated under the same rules and guidelines set forth by this AGREEMENT.

5. The player agrees to keep all negotiations and agreements between PARENT and (TLAP) confidential. PLAYER is not able to discuss any financial matters with other PLAYERS or PARENTS at any time unless authorized by (TLAP).

6. It is understood that all personal equipment purchased and worn by player will be in compliance with (TLAP) and that it is up to the PLAYER to keep said equipment in safety compliance with (TLAP). PLAYER agrees that the return of team issued goods upon suspension, termination, or completion of the players’ services is the sole responsibility of the PLAYER and non-returned or lost goods will be charged to PLAYER or PARENT at replacement cost.

7. This agreement shall be governed and constituted in accordance with the laws of the State of Florida, including the choice of law principles thereof. The PARTIES agree that any dispute be-tween the parties concerning this Agreement, may at the sole discretion of (TLAP), be resolved by binding arbitration before a neutral, mutually acceptable arbitrator and shall be conducted pursuant to the arbitration rules as promulgated by the American Arbitration Association, and the hearing shall be conducted in the State of Florida. Equitable claims, including but not limited to pre-liminary injunctions, temporary restraining orders, and declaratory judgments, however, shall not be resolved by arbitration but instead shall be resolved in a court of law. The PARTIES agree that any action in equity relating to this Agreement be brought in the State of Florida, WITH ALL RIGHTS TO A JURY TRIAL WAIVED. The PLAYER and PARENT agree to reimburse (TLAP) for its reasonable attorneys’ fees in the event that (TLAP) is substantially the prevailing party in action or actions.

8. The player and parent acknowledge that any breach of agreement, is likely to result in immediate, irreparable harm to (TLAP), for which damages are not reasonably ascertainable. The PLAYER and PARENT agree, therefore, that, upon a showing that the PLAYER or PARENT is about to breach, or has breached, any such Section, (TLAP) shall be entitled to a preliminary in-junction and other equitable relief as necessary to enjoin the PLAYER or PARENT from threatened, further or continuing breaches thereof. The PLAYER and PARENT agree to waive notice of such preliminary injunction hearing and understand that ex-parted relief may be sought by (TLAP). In no event shall (TLAP) be liable for consequential damages, in contract or tort, for any breach of this agreement.

9. Neither (TLAP) nor any affiliate, officer, director, attorney, or agent of (TLAP) shall have any liability with respect to, and PLAYER and PARENT hereby waive, release, and agree not to sue any of them under any claim for special, indirect, incidental, or consequential damages suffered or incurred by PLAYER in connection with, arising out of, or in any way related to, this AGREEMENT, including death or personal injury. PLAYER and PARENT hereby waive, release, and agree not to sue (TLAP) or any of (TLAP)’s affiliates, officers, directors, attorneys, or agents for punitive damages in respect of any claim in connection with, arising out of, or in any way related to, this AGREEMENT, including death or personal injury.

10. If any provision of this AGREEMENT shall be invalid or unenforceable under any applicable law, such provisions shall not apply in such instance, but the remaining provisions shall be given their full effect in accordance with their terms.
11. This document constitutes the entire agreement between the parties and can only be modified by a written agreement signed by the PARENT, PLAYER, and by (TLAP). All prior or contemporaneous oral representations are of no force or effect.

PLAYER and PARENT acknowledge that failure to abide by the rules set forth in this AGREE-MENT constitutes a breach of the same and subjects the PLAYER and PARENT to disciplinary action and possible expulsion from (TLAP). More detailed information regarding code of conduct, financial responsibility and related consequences can be found in the specific club addendums. We hereby agree to the terms and conditions of this Agreement, waive any liability, and acknowledge that we have read, understand and agree to abide by the rules and regulations set forth herein, and agree to be legally bound by this Agreement.

Agreement

POLICY: IF PAYMENT IS NOT RECEIVED WITHIN (2) DAYS AFTER DUE DATE, THE CREDIT CARD, DEBT CARD OR BANKING ACCOUNT ON FILE WILL BE CHARGED FOR THE TUITION AMOUNT PAST DUE AS WELL AS A 3% CONVENIENCE FEE

Should PLAYER or PARENT fall into arrears on these payments for any reason, time being of the essence, this shall be considered a material breach of this agreement, and TLAP shall be entitled to refuse to allow the PLAYER to continue to participate in the games/practices remaining, in addition to any other remedies it is entitled to hereunder. I understand that if my account is 4 days or more delinquent, TLAP Sports Academy, Inc, at its option, may dismissed student athlete from program. Parent(s) must agree that the student named may participate in all TLAP Sports Academy activities. I also understand that all parents have the right to withdraw their child at any time during the year. If student is dismissed from TLAP Sports Academy or parent withdraws their child at any time during the year for any reason. All remaining payments will be accelerated into one payment.

After the 4th of each month a $150 late fee assessed to student account balance. If student athlete is injured during year and cannot continue. The parent is still responsible for the remaining tuition cost regardless of student injury. Regardless of any reasons parents are responsible for the full tuition payment for the year no exceptions. I further understand and agree that I am not entitled to any refund from TLAP Sports Academy. Payments, tuition payments, deposits, donations, and gifts to TLAP Sports Academy. Please note once payment is made through payment portal or invoice, all payments are final no exception.

You agree to voluntarily make payments under your own understanding and knowledge. I, agree and commit to be faithful to the financial terms and conditions regarding TLAP Sports Academy tuition payments for the school year. If all tuition payments are not received by TLAP Sports Academy, payee will be pursued in court to recover all monies owed to TLAP Sports Academy, plus lawyer fees associated with court case.

Nothing herein shall be considered as a waiver of (TLAP) right to collect tuition payments provided herein. PLAYER and PARENT agree that payments are not set up to be evenly pro-rated over the course of the year. PLAYER and PARENT understand that payments are front weighted toward the start of the year and travel are greater for this period and therefore consume the vast majority of player fees. By signing this document, you are committing to the payment terms and conditions listed. Failure to pay as agreed may result in dismissal from (TLAP). Terms of this agreement are laws governed by the state of Florida. This document must be signed before competing in any team function sanctioned by (TLAP).

I certify that I have read all terms of the acceptance packet, I have discussed them with my parents and/or other staff representatives of the institution named above, and I fully understand, accept and agree, to be bound by them. Tuition cost for each family is to remain strictly confidential at all times between the TLAP Sports Academy Preparatory and parents/guardians, and the applicant. Information may not be shared with any parties outside this agreement. This Agreement and each party's obligations shall be binding on the representatives, assigns, and successors of such party.

PLAYER: I hereby state that:

I, as a player, will use every effort to be a positive member of my team and exhibit good sportsmanship at all times. I will keep in mind that this is an extra-curricular activity and will keep my grades and behavior at an appropriate level so that I may participate. I will attempt to attend and actively participate in every practice and event scheduled. If I cannot make it, I will inform my coaches as to why I am unable to attend. I will practice and play to the best of my ability. I recognize that I am playing a team sport; as such the interests of the team shall take precedence over individual exploits. I will not criticize the performance of another teammate, a coach’s decision, a referee’s call or an opponent. I will conduct myself in a respectable manner at practices and at games. I will not attempt ever to deliberately injure another player. I realize that failure to comply with the above regulations will result in loss of game time or suspension from athletic participation.

Provide positive support, care, and encouragement for my child’s participation in TLAP Sports Academy Preparatory sports by following this code of ethics. I will encourage good sportsmanship by demonstrating positive support for all players, coaches and officials at every game, practice, or other events. I will place the emotional and physical well-being of my child ahead of any personal desire to win. I will insist that my child play in a safe and healthy environment. I will demand a drug, alcohol and tobacco free sport environment for my child and agree to assist by refraining from their use in the playing facilities. I will remember that the game is for the athletes and not for the adults. I will ask my child to treat other players, coaches, fans, and officials with respect, regardless of race, sex, creed or ability. I will make every effort for my child to attend all practices and games and I will give proper notification to the coach if they are unable to attend. I will see that all the requested fees are paid on time before my child participates. I will not talk against coaching staff style of coaching, decisions, training methods, player rotations, disciplinary actions within the scope of team rules with other parents, players and teams. If, I am found to be in violations of the parent/player contract. My child will be dismissed from program immediately. I will be a parent not a coach. And do my fair share of any duties asked of me.

Student athletes will room with 4 or 6 student athletes to a room or hotel suite depending on hotel location. Student athletes will not vandalize nor destroy hotel property while in program. If student athlete violates agreement, parents are responsible for damage of property and whatever applicable cost that will occur from damaging the property.

All players will sit together in gym when entering gymnasium. No player will seat differently from team. All players will exit looker room together while leaving gym. All players will sit together when leaving locker room. 3 warnings will give to said player. Third violation will result in 2 game suspension. And 20 deep six’s each day suspension total of 60.

If parents need to contact student athlete, parents must call 850-___-____ to contact student athletes while in gym. Once student athletes return to hotel, they may retrieve their phones. 3 warnings will give to said player. Third violation will result in 2 game suspension. All student athletes will be to transportation 30 mins before departure. Student athletes must check in before departing. 3 warnings will give to said player. Third violation will result in 2 game suspension. And 20 deep six’s each day suspension total of 60.

You must sign this form to participate (practice or compete) in athletics at TLAP Sports Academy Preparatory. Failure to sign this form will result in the student-athlete not being able to participate in any organized team activities at TLAP Sports Academy Prep. If you have any questions, you should discuss them with the Head Coach.

You agree to allow TLAP Sports Academy Preparatory to test you in relation to any participation by you in any TLAP Sports Academy Preparatory sponsored athletic program for drugs and alcohol including the NCAA Banned Substances List. For an ongoing updated listing of the banned drug list, view the NCAA’s web site at www.ncaa.org. TLAP Sports Academy Preparatory will be testing student-athletes on an on-going and random basis throughout the current academic year.
All (14) student athletes will be selected for several dates throughout each prep year, Aug, Sep, Oct, Nov, Dec, Jan, Feb , March.

Athletes may also be selected based on reasonable suspicion of drug use and may include a steroid panel, synthetic marijuana, marijuana (THC), tobacco, cigarettes, vapes, e-cigarettes, Amphetamine, Barbiturates, Benzodiazepines, Cocaine, Ecstasy, Methadone, Morphine Oxycodone, Phencyclidine, and Tricyclic. The selection of student athletes to be tested will be random, but also focused on those who indicate a reasonable suspicion of abuse in the eyes of administrators, medical professionals and coaches.

Penalty:

Specific athletic department penalties are as follows. However, as in the case with any violation of the student conduct code, any violation, even a first offense, can be punished with sanctions up to and including expulsion, depending on the nature and circumstances of the violation, the prior record of the student, and other factors deemed pertinent. Athletes that test positive for ADHD medication, must have had proper diagnoses and have documentation of such medication on file in the sports medicine department.

Consequences for a Positive Drug Test

First Positive Test:

⦁Meet with AD and/or Sport Administrator and Head Coaching Staff
⦁Parent(s) or Guardian will ordinarily be notified
⦁Possible suspension from practice and/or competition
⦁Regular drug testing
⦁Mandatory counseling
⦁Subjected to further testing: A mandatory follow-up test will be required (the student athlete results must be negative)
⦁Test results will be placed in student file.

Coaches Use of Positive Test:

Student-athletes should understand that a positive test result will be made known to prospective college coaches and that the coach will consider such positive test result(s) in assessing an individual’s ability and in determining which individuals should be afforded the privilege of becoming a member of that college or university roster that represents their intuition. Nothing contained in this Policy shall be construed as preventing a head coaching staff from imposing a more severe sanction than those provided in this policy.

Second Positive Test:

⦁Meet with AD and/or Sport Administrator and Head Coach
⦁Parent(s) or Guardian will be notified
⦁Suspended from team immediately/terminated.
⦁Test results will be placed in file and sent to college coaches which are currently recruiting the student athlete.

iii. Safe Harbor:

If a student athlete admits to drug use and is seeking treatment, they will not be penalized. However, coming forward after the student-athlete has been informed of an imminent test or of a positive test result will not result in protection from this provision.

To be tested by TLAP Sports Academy Preparatory in accordance with the TLAP Sports Academy Preparatory student athlete drug-testing policy (located on the TLAP Sports Academy Preparatory Athletics Website), which provides (among other things) that: I will be notified of selection to be tested. I must appear for a TLAP Sports Academy Preparatory test or be sanctioned for a positive drug test; and my urine sample collection will be observed by a person of my same gender. To accept the consequences of a positive drug test from both athletics and student affairs as stated in the student athlete policy.

To allow disclosure of my drug-testing results to the college administrators, appropriate athletics department personnel, coaches and parents for purposes related to participation in sanctioned TLAP Sports Academy Preparatory athletics activities.

I understand that if I sign this statement falsely or erroneously, I violate the TLAP Sports Academy Preparatory student honor code and the athletic department Code of Conduct and will jeopardize my participation in sanctioned TLAP Sports Academy Preparatory athletics activities.
